Wave of Protests After Grand Jury Doesn’t Indict Officer in Eric Garner Chokehold Case

By J. DAVID GOODMAN and AL BAKERDEC. 3, 2014

A Staten Island grand jury on Wednesday ended the criminal case against a white New York police officer whose chokehold on an unarmed black man led to the man’s death, a decision that drew condemnation from elected officials and touched off a wave of protests.

The fatal encounter in July was captured on videos and seen around the world. But after viewing the footage and hearing from witnesses, including the officer who used the chokehold, the jurors deliberated for less than a day before deciding that there was not enough evidence to go forward with charges against the officer, Daniel Pantaleo, 29, in the death of the man, Eric Garner, 43.

Officer Pantaleo, who has been on the force for eight years, appeared before the grand jury on Nov. 21, testifying that he did not intend to choke Mr. Garner, who was being arrested for allegedly selling loose cigarettes. He described the maneuver as a takedown move, adding that he never thought Mr. Garner was in mortal danger.

The decision came barely a week after a grand jury found no criminality in the actions of another white police officer, Darren Wilson, who shot and killed Michael Brown, an unarmed 18-year-old black man in Ferguson, Mo.

What's worse than doing something wrong? Having so much contempt for your victim to deny that wrongdoing took place. The STATE killed this unarmed black man, Eric Garner. Today, his killing was applauded as a just response to selling untaxed cigarettes. THE MESSAGE IS CLEAR: OBEY OR PAY THE PENALTY. (i.imgur.com)

The choker began before he was on the ground in an attempt to restrain him and after he said he can't breath he released him from the hold but kept his head down. Also, after someone already resists are you really going to believe them when they say they aren't breathing? I reckon he's a idiot (the officer) because at that point I would have released the pressure but it's also fair to keep him under some sort of control.

bollocks.

in what way did he resist arrest?

How many officers were on him, but its fair to keep a chocker hold on him to keep him under control?

Its state sanctioned thuggery.

Just before the dude jumps on him to get in the choker.

Once he was under control he was released from the choker which is pretty soon after being on the ground. Even then he was still struggling.

It all could of gone a lot smoother

that would have to be one of the most compliant arrests a copper could hope to make.

if that is resisting then the cops may as well start shooting all suspects rather than put their own lives at risk when the person does actually fight back.

i though you were taking the pee with your original comment, yeahright, but am stunned that you would actually think he was resisting. probably time to get your head out of the books and witness the real world.

I wouldn't joke around with a death like this. Just to reiterate, I do believe it was over the top from the police officer BUT I also believe it could have gone a lot smoother. He's a big boy and extra attempts had to of been made to get him down and if you all don't believe he was resisting then fair enough you are entitled to think that and I won't be able to convince you otherwise I guess I just see it differently.

FWIW telling me to "witness the real world" is a belittling comment with no substance as I have seen and experienced enough arrests to form my own opinion so it would be fair not to make assumptions based off nothing.
