You do the math??

A close friend of mine, actually he was in my bridal party was at Beach Hotel in Port Melbourne last night.

He calls me up to tell me he was waiting to enter the cubicle at the toilets and 2 guys walk out together out of one.

One plays for a club and he is one of their best.

Now i wonder what was going on there??

The legal injunction on naming players and clubs means we can't discuss or even allude to players using drugs or even the club they play for whether it is a fact or rumour.

We know that there are AFL players out there who use illicit drugs and some are on two strikes yet they don't have to undergo the rigorous testing or face the 'one slip and your gone' conditions Ben does.

But for OER's sake and the admins we can't afford to take the legal risk.

A popular Hawthorn forum was shutdown a couple of years ago due to naming one of their own players. It's classed also as defamation btw.

But surely someone should be allowed to say what they saw, be it prima facie or not as long as no accusations are made. eg I saw or my mate saw x and y come out of the toilets at the pub the other night. If no accusations are made, I can't see how that would be defamatory. If he said I saw x and y coming out of the toilets and I bet they were doing z then that is defamatory. eg what if someone said I saw Cogs and Polak driving down the street together the other day. Is there a difference?
 
However, with daniel's final comment, "Now i wonder what was going on there??" could have the potential to bring on speculative replies which would no doubt have the potential to be defamatory.

Anyway food for thought. Lets not let freedom of speech be a victim here.

But in some ways freedom of speech has become a victim in this because a club was publicly named by Ch 7 with evidence (from stolen medical records) which caused the injunction in the first place which says no one anymore can say which club it was nor the players involved even though we all know which club was named. On top of that we are also forbidden by law to allude to or accuse any club or player at all regarding drug taking or strikes now. As far as I read it even if you have 100% proof of an AFL player using illicit drugs (so it's not defaming as it's a fact) you would still be in violation of the injunction in naming the player and/or his club  :P. It's a slippery slope so IMO for OER's sake and us admins I'd rather play it safe on this illicit drugs issue.
