Collingwood could face legal action over cheer squad clean-out (Herald-Sun)

Collingwood could face legal action over clean-out
Cheryl Critchley | December 20, 2008

COLLINGWOOD fans dumped from its new hand-picked cheer squad may be able to take legal action.

Magpies cheer squad members are sweating on whether they will be reinstated when the group is finalised in late February.

Collingwood president Eddie McGuire will not reveal the criteria being used for selection, but told the Herald Sun members had to cheer and work hard.

"The club knows what it's doing," he said.

"Why would we throw anyone out who's well behaved?

"The cheer squad's been a great cheer squad and we love them all, but we just want to make sure that people get a fair go at things and they're actually there to cheer and not carry on."

Consumer Action Law Centre senior solicitor Michael Hermitage said axed squad members could have a case under the Fair Trading Act or Equal Opportunity Commission.

They could use the Fair Trading Act if they believed they had a contract with the club that led them to believe their position would continue.

"You need to look at what they do and try to establish whether or not there are grounds to challenge that position," Hermitage said.

Asked what specific incidents had prompted the clean-out and how the club would screen potential members, Collingwood spokesman Nick Hulett declined to comment.

Collingwood was also criticised for charging cheer squad members up to $795 compared with $316 for similar benefits at Richmond.

Premier John Brumby, a Collingwood fan, said he hoped his club would keep footy affordable for all.

Collingwood are safe.

There's absolutely no way their supporters could be involved in a class action.  ;)

Wouldn't have a clue if they could from a legal point of view.   ;)

They can't be involved in a class action with no class.

Footy fans to sue El Presidente
Tuckerbag Express| 24 December 2008

PS for this article to take on any significance please read by putting forth your best feral voice on in your mind especially for Bazza Dazza and Kazza.

Fans wearing black and white are revolting. Before you agree with me and concur wholeheartedly on their collective putridness they are also revolting against their footy club and are preparing to sue the club with regards to their lack of opportunity to sit with their clubs cheer squad. The fans are united in their grief and are prepared to go a long way to be able to have the unique opportunity to sit here and taking their case to court seems to be the go for them.
One such fan who wants to be known as Maggots but whose real name is Bazza was one of many fans who came forward to present his side of the story. He was in the minority as he had served his parole and was not in violation of it.
" Yeah its a fu---- outrage. I been a member all my fu---- life and have sat there all the time at the footy. I been fu---- arrested 58 times at the footy and cant fu---- understand why I am being singled out. Now that I have served my fu---- parole and that I thought it would be great to go to court and not be the one thats gonna get in fu---- trouble but be the one who is gonna get someone else in trouble."

Similar sentiments were expressed by a woman who the group sees as a matriarch and is known as Kazza.
" Yeah I been sitten there all my fu---- life. In fact I was fu---- born there on match day when we beat Footscray by 122 points  in 1978. Its like a family to me. Me mum me many dads me sisters the moles they fu---- keep stealing me fu---- boyfriends, me brovvers all me boyfriends and all the dads of me 12 rugrats. We all yoused to huddle togevver at Vic Park in the RT Rush stabd and there's fu---- heaps more room at the MCG so why shouldn't we sit togevver. So some punce can make make a few extra lousy dollars. I'm proud to say I haven't fed some of me kids for mumfs so I can scrape some cash togevver and go to the footy after I've bought me VB and IC Coolers and cartons of Peter Jackson Virginias. How much more do they want from us. My youngest free kids are now old enough to be charged an entry fee, its a fu---- disgrace"

President of the football club EM gives us his spiel.
" We are a traditional football club. In fact the most traditional of all footy clubs in OZ. Our black and white colours symbolise who we are and are the ethos of this club. We are proud of our traditions and the fact we are the only ones who don't have a change jumper even when we play away. So what? What difference does it make? Even if we called ourselves the Toorak Magpies we would still wear black and white guernseys and just merely have  just a few more sponsorship dollars than everybody else coz me neighbours promised me that they would throw some loose change at me so long as I never set foot on their properties ever again. Now that's business acumen and traditions for you and we are a very traditional and progressive footy club".

Sceptics from other clubs just see this all as a scam to merely attract attention to them as they no longer are the box office smash they thought they were. In fact some within the inner sanctum of EM's club have claimed that they are the Terminators although many others outside "The Club" have expressed their view on being nothing more than Deuce Bigalow Male Gigolos with their dorky lack of success and severe overestimation of themselves. Perhaps the best way to sum them up comes from this digruntled fan known as Dazza.

"Why should I fu---- have a fu---- interview to fu---- sit in the fu---- cheer squad. My fu---- dad told me if I ever was in a interview to not say a fu---- word. Best advice I ever fu---- got. I'm wif Bazza. I'm gonna fu---- sue'em. If I can't sit where I fu---- want at the footy then I'll fu---- go back to disturbing the peace and fathering kids to women I fu---- pick up at the 21st century dance club"

A stalemate indeed has been reached and both parties it seems are not budging. On one side we have a club who prides itself on its so called traditions and prides itself on the level of support it has and yet it prepared to victimise these very supporters who are the reason we laugh at them so much and on the other we have these so called ostracized fans who throughoout their lives have had plenty of access to legal aid but alas for them in this case that's defence lawyers and therefore they wouldn't have the foggiest idea on where to go and how to issue a writ in this case. Where to from here?
Probably another season of overestimation where they will be seen by some absolute bona fide tools as possible grand finalists and maybe even premiers but when the dust settles they will be so far away from the last Saturday in September it will be absolute laughable considering some of the garbage we will be hearing about in May and possibly June. In my humble opinion it could only happen at this footy club and in an environment where the Kazza's Bazza's and Dazza's of this world are a dime a dozen. So in summing up thank you for taking the time out reading this and who cares. There's more to life than cheer squads and black and white footy jumpers you pathetic footy club. Thank God I don't support you.

Tuckerbag.

Nice one tuckerbag ;D  :clapping

I think I sat near Bazza and his vocabulary in 2006 when the Pies only managed one goal to half-time. Drinking plastic cups of Bourbon non-stop for 2 hours was his answer to a day out at the footy  :help until he left halfway through the 3rd qtr. He got so smashed as he was leaving he feel forward over the top into the next row of seats below  :lol.
