Richmond forward Dustin Martin has been suspended from driving for two months but was exonerated on a charge of driving an unregistered vehicle on Thursday.
Martin was pulled over on March 31 and was later summonsed on charges of driving while suspended and driving an unregistered vehicle.
However, in an appearance at the Moorabbin Justice Centre on Thursday, the Victoria Police prosecution accepted Martin had the relevant defence of “honest and reasonable mistake” when driving the vehicle, a Jeep which had been given to him in a third-party arrangement.
It was deemed that the responsibility of registering the car rested with the vehicle’s owners, Jeep.
Martin was, however, suspended from driving for a further two months from Thursday, and fined $750 for driving while suspended, although no conviction was recorded.
Martin’s initial suspension stemmed from running a red light in the Malvern area while he had undertaken the ‘golden point’ invitation after running out of demerit points in 2013.
It was argued by defence barrister Neil Howard that no correspondence from VicRoads on the suspension was received by Martin, as he moved house in November 2013 and the suspension notice was dated December 31.
The 23-year-old is part of the Korin Gamadji Indigenous Institute, which mentors and educates Indigenous youth.
Magistrate Crisp took this into account and could have imposed a ban of up to 12 months, but exercised discretion and imposed a further ban of two months effective immediately.
